The Index to State Grants of South Carolina in South Carolina Archives at Columbia, South Carolina shows five land grants to James Massey in Pendleton Dist. most of which were on the branches of Chauga "of Tugaloo River." See State Grants, Vol. 62, p 465&467; Vol. 63, p 247, 284, and 275. All were dated 1819. The grant in Vol. 63, p 284 refers to land of Charles McClure and James Massey's own lands. This is important, for when James Massey moved to Jefferson County, Alabama he sold land "on Chauga waters of Tugaloo River" to Charles McClure. This deed to McClure was dated Sept. 9, 1826 but was only for 50 ac. It was not recorded until 1852. (Deed Bk. G1, p 144, Pickens Co) On April 8, 1826, James Massey had sold "the plantation on which James Massey now lives" to one David Russell, being land originally granted to Josiah Burton according to the deed. (Deed Bk. G1, p 301 Pickens County, South Carolina) This area is now Oconee County, South Carolina. As our James Massey went to Alabama between 1826 and 1828 (the year Harriet was born in Alabama), these sales must certainly have been of his land. James Massey was buried in the oldest Cemetery in Jefferson County, Alabama. It was known as Old Pioneer Cemetery and was also called the Roebuck Mann Cemetery. It was located on 3rd Ave. and 33rd St. So. in what is now Birmingham, a late-built city. He was buried there with his sons David and Thomas Allen Massey. All markers were removed or destroyed and a "putt putt golf course" is now on top of what was the Cemetery. James and Mary Nation(s) Massey were members of Canaan Baptist Church and their joining there in 1831 by letter coincides with that of Abraham and Rebecca Nations. The notation appears under the records of each of the four "Charter mem. Elyton." This church met near Elyton (which be
came Birmingham) until about 1825 when it moved to Jonesboro, now Bessemer.

Many years ago, my wife and I visited a very old lady who descended from Josiah and she was of the view that James Maynard Massey named in Josiah's will must have died because the land given him under the will went to his younger brother with whom his mother was pregnant when Josiah wrote his will. But that only meant that they thought, or chose to think, that he was dead or was so far removed that he would never have any use for the land. Here is what the will of Josiah Massey of Kent Co.Maryland said: "To my son James Maynard Massey all my lands in Kent County called "Forest" * * * If he dies before 21, then to child my wife is now pregnant with" (if that child died, the property would go to nephew Cuthbert Hall.) Executors were his wife Elizabeth and "my nephew Cuthbert Hall". Witnesses were Turbutt Wright, James Spry, Stephen Giant. will written Dec. 16, 1789 proved Jan. 20, 1790.
